The terms "us", "we", "our" refers to Doula Keesha as a company. The term "you", "your" refers to site visitors, customers and any other users that come to the site. Doula Keesha provides mental, emotional, physical and spiritual support for prenatal and postpartum clients through educational programs, one on one services, yoga sessions and through product creation.

Use of Site and Service

To use or access the site, you need to be 18 years of age or older. Children are prohibited from using this website. The information on the site is subject to change. Doula Keesha site information makes no representation or warranty that the information stated is without error, regardless of the source.

Account Creation

​

In order to use the site, you must enter your own information that is current and accurate. You must not impersonate someone else or provide account information other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

 

Lawful Purposes

You agree to use the Site and to purchase services or products through the site for legitimate, non-commercial purposes only. You shall not post or transmit through the site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law.

Refusal of Service

The Services are offered subject to our acceptance of your order. We reserve the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so. No order is deemed accepted by us until payment has been processed. We may at any time change or discontinue any aspect or feature of the service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.

Health Terms

Physical exercise, with or without the use of equipment such as blocks, straps, or any other equipment that may be suggested by Doula Keesha, is a strenuous physical activity. You are encouraged and to seek the advice of a physician before beginning any exercise regimen, routine, program, or using any suggested equipment. Doula Keesha is not a medical organization and cannot give you medical advice. All suggestions and comments relating to physical movement, with or without the use of equipment, are not required to be performed by you and are carried out at your election. By using the Service, you represent that you understand that physical exercise involves strenuous physical movement and that such activity carries the risk of injury. You expressly waive and release any claim that you may have at any time for injury of any kind against Doula Keesha.

Technological and Use Limitation

​

We will make reasonable efforts to keep services functional and running. If there are unforseen circumstances, Doula Keesha reserves the right to modify the service as needed with or without notice and shall not be held liable to you.

Reproducing and redistributing content from the site is prohibited. Doula Keesha reserves the right to terminate your access and purse legal action if you are violating terms.

Terms, Fees, Payments, Returns

​

By registering for the Service, you agree to pay the applicable rate when charged.

 The fee for use of the Service will be charged to the credit card or the payment type designated during the service registration process. You agree to pay all fees and charges at the rates in effect when the charges were incurred.

If you are purchasing a physical item or virtual item, contact me within 3 days of delivery, if you have any problems with your order. For physical items only, ship items back within 7 days of delivery if needing a return. Request a cancellation within 2 hours of purchase for either virtual or physical items. Buyers are responsible for return shipping costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value.

Any fees that are paid for birth doula services will not receive monetary compensation. In lieu of monetary compensation, client will receive a sufficient amount of postpartum hours. If you have a request for a different arrangement, please email doulakeesha@gmail.com with your request. Approvals of request will be on case by case basis.

 

Any fees that are paid for postpartum doula services will not receive monetary compensation. In lieu of monetary compensation, client can reschedule hours for a more opportune time with Doula Keesha or will be provided with a Doula Keesha back up.

 

You agree to pay Keesha Hernandez all reasonable attorney’s fees and costs incurred by Keesha Hernandez to collect any past due amounts. Your account may be deactivated without further notice if payment is past due, regardless of the dollar amount. You agree to pay any outstanding balance in full within thirty (30) days of cancellation or termination of your Service account.

 

You are responsible for paying any governmental taxes imposed on your use of the service, including, but not limited to, sales, use, or value-added taxes. You are solely responsible for arranging payment for any and all additional or premium charges for your use of any third-party services.

 

Doula Keesha reserves the right to change the Service fees and billing methods. Notice of billing changes may be provided via email or by posting on the Website. If a change is unacceptable to you, you may terminate your account Your continued use of the Service following the effective date of a change to such fees and billing methods shall constitute your acceptance of such change.

Shipping and Fulfillment 

When purchasing a physical product, it will be delivered within 5 business days. Shipping costs will be paid based on where you live and will be calculated according to USPS services. Doula Keesha will ship within the US and Internationally. If you spend $45 or more, shipping will be at no cost to you. If there is a delay in shipping, it is your responsibility to let us know, in case we don't know about the delay on our end. Feel free to email doulakeesha@gmail.com with that information. Please allow 24 hours for a response.

Limitations of Liability

​

You hereby agree that Doula Keesha will not be liable for indirect, special, or consequential damages (including personal injury) or any loss of revenue, profits, or data arising in connection with this Agreement or the Service, even if advised of the possibility of such damages. Furthermore, our aggregate liability arising with respect to this Agreement and the Service will not exceed the total fees paid by you under this Agreement.
